Intellectual Property & Trademark Policy
How BOLIAPP Private Limited protects its trademark and content, what rights you keep in what you post, and how rights holders can report infringing listings.
1. Overview
This policy explains how BOLIAPP Private Limited (“BoliApp”, “we”) protects its own intellectual property, what rights you keep in the content you post, and how rights holders can ask us to remove listings that infringe their trademarks, copyrights or other rights.
It is governed by the laws of Pakistan, including the Trade Marks Ordinance 2001 and the Copyright Ordinance 1962, and forms part of our Terms of Service (/legal/terms-of-service).
2. The BOLIAPP trademark and our brand
“BOLIAPP” is a trademark of BOLIAPP Private Limited, registered in Lahore with the Intellectual Property Organization of Pakistan (IPO-Pakistan) under the Trade Marks Ordinance 2001. The BoliApp name and logo, the tagline “Har Deal Ki Pehli Boli”, and the product names BoliTrust and BoliAI are also brand identifiers belonging to BOLIAPP Private Limited.
You may not use these marks, or any name, logo, domain name, social media handle or app name that is confusingly similar to them, without our prior written permission. This includes using them in a store name, listing title or advertisement in a way that suggests you are BoliApp, or that you are endorsed by or partnered with BoliApp.
You may refer to BoliApp in plain text to say truthfully that your items are available on BoliApp, for example “Find my store on BoliApp”, as long as you do not use our logo or imply a special relationship with us.
3. Other BoliApp content and technology
Apart from content posted by users, everything on boli-app.com and in BoliApp’s apps belongs to BOLIAPP Private Limited or its licensors and is protected by Pakistani and international intellectual property laws. You may not copy, scrape, reproduce, modify, distribute, sell or create derivative works from it, or use automated tools to collect data from BoliApp, without our prior written permission, except as needed for normal personal use of the service.
This protection covers, among other things:
- The design, layout, look and feel of the website and apps.
- Software, source code, algorithms and the systems behind features such as BoliTrust and BoliAI.
- Text, help and guide articles, graphics, icons, illustrations and videos created by BoliApp.
- Collections of data, such as listings, categories and price information, as organised and presented by BoliApp.
4. Your content and the licence you give us
You keep ownership of the photos, descriptions, reviews and other content you post on BoliApp. We do not claim ownership of it.
By posting content, you give BOLIAPP Private Limited a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display, adapt (for example, to resize, crop, translate or enhance images) and distribute that content in order to operate, improve and promote BoliApp, including showing your listings in search results, on social media and in marketing. This licence is described in our Terms of Service and lasts for as long as the content remains on BoliApp, plus a reasonable period afterwards for backups, records, legal compliance and marketing material that has already been published.
5. Only post content you have the right to use
You are responsible for making sure that you own, or have permission to use, everything you post. In particular:
- Do not copy photos or descriptions from other sellers, brand websites or online stores without permission. Take your own photos.
- Do not use brand names or logos in a listing except to describe, truthfully, a genuine product made by that brand.
- Do not sell or share pirated software, films, music, games, e-books or digital accounts, or unauthorised copies of any copyrighted work.
- Do not post someone else’s artwork, designs or writing as your own.
- Do not use trademarks in keywords, store names or titles to mislead buyers about where a product comes from.
6. Counterfeit and replica goods
Counterfeit, fake, “first copy”, “master copy”, “replica”, “AAA quality” or other imitation goods that copy a brand’s trademark or design are prohibited on BoliApp, even if the listing says the item is not original. Selling counterfeit goods can also be an offence under Pakistani law.
If you sell branded products, you must be confident that they are genuine and, if asked, be able to show proof such as purchase invoices or authorised dealer documents. See also our Prohibited Items Policy (/legal/prohibited-items).
7. How to report infringement (notice and takedown)
If you own a trademark, copyright or other intellectual property right, or are authorised to act for the owner, and you believe that content on BoliApp infringes it, send us a written notice through boli-app.com/help/contact or by email to info@boliapp.pk, with “IP notice” in the subject line.
To help us act quickly, your notice should include:
- Your full name, the name of the rights owner (if you are acting on their behalf), and your postal address, phone number and email address.
- A description of the right you are relying on, with proof, such as a trademark registration certificate issued by IPO-Pakistan, a copyright registration, or other evidence that you own the mark or work.
- If you are an agent, law firm or distributor, proof that you are authorised to act for the rights owner.
- The exact URL of each listing, store or other item of content you are reporting, and an explanation of how each one infringes your rights.
- A statement that you believe in good faith that the use of the material is not authorised by the rights owner, its agent or the law.
- A statement that the information in your notice is accurate and that you are the rights owner or are authorised to act on their behalf.
- Your physical or electronic signature.
8. What happens after we receive a notice
We review every notice we receive. If a notice is incomplete, we may ask for more information before acting. Where a notice appears valid, we may remove or disable access to the reported content, and we will usually inform the user who posted it. We may share the details of the notice, including the rights owner’s name and contact details, with that user so that they can respond.
Removing content in response to a notice is not a ruling by BoliApp on who is legally right. BoliApp cannot decide legal disputes between users and rights owners; where the parties disagree, they may resolve the matter between themselves or before the competent courts or authorities in Pakistan.
9. Counter-notice for sellers
If your content was removed because of an infringement notice and you believe this was a mistake — for example, because the product is genuine, you own the photos, or you have the rights owner’s permission — you can send a counter-notice through boli-app.com/help/contact or to info@boliapp.pk.
We may share your counter-notice with the person who sent the original notice. After reviewing it, we may restore the content, keep it removed, or ask either side for more information. Your counter-notice should include:
- Your full name, contact details, and the email address or phone number linked to your BoliApp account.
- The URLs of the removed content.
- An explanation of why you believe the removal was a mistake, with supporting evidence such as purchase invoices, authorised dealer documents, original photo files or a licence.
- A statement, made in good faith, that the information in your counter-notice is accurate.
- Your physical or electronic signature.
10. Repeat infringers and misuse of this process
We will suspend or permanently close the accounts of users who repeatedly post infringing content or counterfeit goods, and their BoliTrust score may be reduced. Depending on the case, we may also remove all of their listings, restrict their store and preserve records for any legal proceedings.
Notices and counter-notices must be honest. Sending false or misleading notices, for example to remove a competitor’s genuine listings, is a misuse of this process. We may disregard notices from people who abuse it and take action against their own BoliApp accounts, and they may be liable under Pakistani law for any harm caused.
For questions about this policy, or to request permission to use BoliApp’s trademarks or content, contact us through boli-app.com/help/contact or at info@boliapp.pk.
