Terms & Conditions
These Terms & Conditions govern your use of BoliApp, the marketplace operated by BOLIAPP Private Limited at boli-app.com and in our apps. They explain our role as a venue that connects buyers and sellers, your responsibilities when you list, chat, make offers, bid and pay, the rules we enforce, and how complaints and disputes are handled.
1. Who we are and acceptance of these Terms
BoliApp is an online marketplace operated by BOLIAPP Private Limited ("BoliApp", "we", "us" or "our"), a private limited company incorporated in Pakistan and based in Lahore, Punjab. These Terms & Conditions (the "Terms") apply to the website boli-app.com, to our mobile apps when they are released, and to every feature, message and notification we provide (together, the "Platform").
By creating an account, posting a listing, making an offer, placing a bid, chatting with another user or otherwise using the Platform, you agree to be bound by these Terms. Under the Electronic Transactions Ordinance 2002, accepting these Terms by clicking, tapping or continuing to use the Platform is as valid as signing a written agreement. If you do not agree, please do not use BoliApp.
These Terms should be read together with the policies listed below, which form part of your agreement with us. Where a specific policy deals with a particular subject in more detail, that policy applies to that subject.
- Privacy Policy (boli-app.com/legal/privacy-policy) and Cookie Policy (boli-app.com/legal/cookie-policy)
- Refund Policy (boli-app.com/legal/refund-policy) for deals paid through BoliApp checkout
- Prohibited Items (boli-app.com/legal/prohibited-items) and Community Guidelines (boli-app.com/legal/community-guidelines)
- Auction Rules (boli-app.com/legal/auction-rules)
- Intellectual Property Policy (boli-app.com/legal/intellectual-property) and Disclaimer (boli-app.com/legal/disclaimer)
2. Eligibility and your account
You must be at least 18 years old and legally able to enter into a binding contract under the Contract Act 1872 to register, buy, sell, make offers or bid on BoliApp. If you use BoliApp on behalf of a business, you confirm that you are authorised to bind that business, and the business is responsible for your activity.
You can sign up with an email address and password, with a phone number verified by one-time password (OTP), or with your Google, Facebook or Apple account. One account lets you both buy and sell. Business users may open a store, which is also subject to these Terms and to any store subscription terms shown at the time of purchase.
You are responsible for everything that happens under your account. BoliApp will never ask for your password or OTP by chat, phone or email, and you should never share them with anyone, including people who claim to be from BoliApp.
- Give accurate, current and complete information, and keep your name, phone number and email address up to date.
- Do not create extra accounts to get around a suspension, inflate reviews or bid on your own auctions.
- Do not sell, rent, transfer or let anyone else use your account or store.
- Tell us immediately through boli-app.com/help/contact if you suspect unauthorised access to your account, a hijacked phone number or a compromised social login.
- We may ask you to verify your phone number, identity or business details before you use certain features, and may limit features until verification is complete.
3. Our role: BoliApp is a venue, not the seller
BoliApp is an intermediary that lets users advertise, discover and negotiate deals with each other, in the same way as other classified and auction marketplaces in Pakistan. When a buyer and a seller want to do a deal, we help them connect, for example through in-app chat and by sharing contact details.
Unless a listing clearly states that BoliApp itself is the seller, the contract of sale, rent, employment or service is made directly between the users concerned. BoliApp is not a party to that contract, does not own, store, inspect or deliver the items, and does not verify that a property, job or service is genuine. Trust signals such as BoliTrust scores, verification badges and reviews help you decide, but they are not a guarantee about any user or listing.
At present, payment and delivery for most deals take place directly between the buyer and the seller, for example in cash, cash on delivery, bank transfer, JazzCash or EasyPaisa. BoliApp does not hold the money in these deals and cannot recover it for you. Section 7 explains how deals paid through BoliApp checkout work.
4. Listings and posting rules
You can post listings for products, property for sale or rent, jobs and services, and choose to sell at a fixed price, accept offers, or run a timed or live auction. Each listing must describe something you actually have the right to sell, rent or offer, and must be placed in the correct category and location.
Listings may be reviewed by our automated systems and our moderation team before they go live and at any time afterwards. We are not obliged to publish or keep any listing, and we may change its category or reject, hide, limit or remove a listing that breaks these Terms or our policies.
- Use your own photos, or photos you have permission to use, that show the actual item; do not use stock or borrowed images to hide its real condition.
- State the true price in Pakistani Rupees, the condition, any defects, and material terms such as warranty, rent period, salary or service charges.
- Do not post the same item repeatedly, in unrelated categories or in cities where it is not available.
- Do not list anything on the Prohibited Items list (boli-app.com/legal/prohibited-items) or anything that is illegal to sell in Pakistan.
- Job listings must be for real vacancies and must not ask applicants to pay any fee to apply or be hired.
- Property listings must be posted by the owner or a person authorised by the owner, and must not misstate the location, size or ownership status.
- Mark a listing as sold, or remove it, promptly once the item is no longer available.
5. Responsibilities of buyers and sellers
Every deal on BoliApp depends on honest behaviour from both sides. Under the Contract Act 1872 and the Sale of Goods Act 1930, the buyer and the seller are responsible to each other for the deal they agree, and provincial consumer protection laws, such as the Punjab Consumer Protection Act 2005, may give buyers additional rights against sellers who supply goods or services as a business.
- Sellers must describe items honestly, honour the price, offer or winning bid they accepted, and hand over the item in the condition described.
- Sellers who trade as a business must comply with the consumer protection, tax and other laws that apply to their trade.
- Buyers must read the full listing, ask questions before committing, and pay the agreed amount in the agreed way.
- Where payment is made outside BoliApp checkout, buyers should inspect the item before paying and meet in a safe public place for in-person deals.
- Both sides should keep their conversation in BoliApp chat, so there is a record if something goes wrong.
- Never send advance payment, "token money" or a courier charge outside BoliApp checkout to someone you have not met for an item you have not seen.
6. Offers, auctions and binding bids
When a listing accepts offers, you may propose a price and the seller may accept, reject or counter it. An offer accepted in the app is a commitment by both sides to complete the deal at that price, unless the item becomes unavailable or both sides agree to cancel.
Timed auctions run until a stated end time and live auctions run in real time. A bid is a binding offer to buy at the amount bid. If you are the highest bidder when the auction closes and any reserve price has been met, you must buy and the seller must sell at that price. Full details, including reserve prices, time extensions and bid retractions, are in the Auction Rules (boli-app.com/legal/auction-rules).
A winning bidder who does not pay, or a seller who refuses to complete a valid sale, harms other users. We may record this on that user's BoliTrust score, offer the item to the next-highest bidder, and restrict that user's bidding or selling privileges.
- Do not bid on your own listing, or ask friends, family or other accounts to bid to push the price up (shill bidding).
- Do not place bids you do not intend to honour, or bid in order to disrupt an auction.
- Do not collude with other bidders to keep prices low, or contact bidders to sell them the item outside the auction.
- We may cancel an auction or void bids where we detect a technical error, fraud, shill bidding or another breach of these Terms.
7. Payments, fees and paid services
Posting standard listings and using the core buying and selling features is currently free. BoliApp may charge for optional paid services, such as featured or boosted listings, store subscriptions and advertising campaigns. The price, duration and what is included are shown before you pay, and you are charged only after you confirm. Fees for paid services are non-refundable except as stated in the Refund Policy or where the law requires a refund.
We are introducing an online checkout through which buyers can pay for a deal on BoliApp. It depends on approval from our payment service providers and may be available only for some listings, users or payment methods. Where a deal is paid through BoliApp checkout, the payment is held by BoliApp or its payment partner and released to the seller under the checkout rules, and the buyer can open a dispute if the item is not received, is significantly not as described, arrives damaged, or there is a payment problem. The Refund Policy (boli-app.com/legal/refund-policy) explains these protections.
Payments made outside BoliApp checkout, including cash, cash on delivery, direct bank transfers and JazzCash or EasyPaisa transfers to another user, are not protected by BoliApp, and we cannot reverse or refund them. Where a wallet balance is held for you, we may delay or freeze it while we investigate suspected fraud, a dispute or a chargeback, or where the law requires it.
- All prices on BoliApp are in Pakistani Rupees (PKR) unless stated otherwise.
- You are responsible for any taxes that apply to your sales or to income you earn through BoliApp.
- Payments are processed by third-party payment providers, whose own terms also apply.
8. Prohibited conduct
You must not use the Platform for anything unlawful, misleading or harmful. Conduct that may be an offence under the Prevention of Electronic Crimes Act 2016 (PECA), such as electronic fraud, identity theft, unauthorised access or online harassment, may be reported to the FIA Cyber Crime Wing or other authorities. In particular, you must not:
- post fake, misleading or bait-and-switch listings, or listings for items you do not have
- commit or attempt fraud, including fake payment screenshots, advance-fee scams, phishing links, or pretending to be BoliApp staff, a bank or another user
- harass, threaten, abuse or discriminate against other users, or share sexual, hateful or violent content
- send spam, chain messages or unsolicited promotions through chat, reviews or listings
- post fake or paid reviews, trade reviews, or manipulate BoliTrust scores
- move a deal off BoliApp to avoid fees, checkout protection or moderation, or use contact details obtained on BoliApp to promote unrelated products or services
- engage in shill bidding, bid manipulation or price collusion
- scrape, crawl, copy or harvest listings, user data or contact details by automated means, or build a database from BoliApp content, without our written permission
- upload viruses or malicious code, probe or overload our systems, or bypass security measures, rate limits or moderation
- infringe anyone's trademark, copyright, privacy or other rights
- share another person's personal information without their consent
- use BoliApp for money laundering, selling stolen goods or any other activity prohibited by the laws of Pakistan
9. Your content and the licence you give us
You keep ownership of the photos, text, videos, reviews and other material you post ("User Content"). You are responsible for it, and you confirm that you have the rights needed to post it and that it is accurate and lawful.
By posting User Content, you give BoliApp a non-exclusive, royalty-free, worldwide, transferable and sub-licensable licence to host, store, reproduce, adapt (for example by resizing, cropping, enhancing or translating), display and distribute it in order to operate, improve and promote the Platform, including in search results, on social media and in advertising for BoliApp. This licence ends when you delete the content or your account, except for copies in backups, content already shared with other users, and records we must keep for legal, safety or dispute purposes.
Reviews must reflect a genuine experience of a real deal. We may remove reviews that are fake, abusive or irrelevant or that disclose personal information, but we do not remove honest negative reviews simply because a seller disagrees with them.
10. AI features
BoliApp uses artificial intelligence (AI) to suggest prices, flag possible scams and risky behaviour, improve search, enhance images, and automatically moderate listings and chat messages. These tools are meant to help you, but they can make mistakes.
AI price suggestions are estimates based on available data, not valuations, and you decide your own price. A scam or risk warning, or the absence of one, is not a guarantee that a user or listing is safe or unsafe. If you use image enhancement, you remain responsible for making sure the final images accurately show the real condition of the item.
Automated moderation may hide content or hold it for review. If you believe content was blocked by mistake, you can ask for a human review through boli-app.com/help/contact. Chat messages are moderated to detect fraud, abuse and prohibited content, as described in our Privacy Policy.
11. Intellectual property
The Platform, including its software, design, text, graphics, logos and the BoliApp and BoliTrust names, belongs to BOLIAPP Private Limited or its licensors and is protected by the laws of Pakistan, including the Copyright Ordinance 1962 and the Trade Marks Ordinance 2001. "BOLIAPP" is a trademark of BOLIAPP Private Limited, registered in Lahore with the Intellectual Property Organization of Pakistan.
We give you a limited, personal, non-exclusive, non-transferable and revocable permission to use the Platform for its intended purpose. You must not copy, modify, reverse engineer, frame, resell or create derivative works from the Platform, or use our name, logo or trademarks, without our prior written consent.
If you believe content on BoliApp infringes your trademark, copyright or other rights, please follow the notice procedure in our Intellectual Property Policy (boli-app.com/legal/intellectual-property) and Section 16 of these Terms.
12. Third-party links, services and advertising
BoliApp shows advertising, including ads served by Google AdSense and campaigns from businesses that advertise on the Platform. Google and other ad partners may use cookies to show ads based on your visits to BoliApp and other websites, as explained in our Cookie Policy (boli-app.com/legal/cookie-policy). Sponsored, featured and boosted placements are labelled as such.
The Platform may link to or rely on third-party websites and services, such as social login providers, maps, payment providers, courier companies and app stores. Their own terms and privacy policies apply when you use them. BoliApp does not control and is not responsible for third-party content, products or services, and an advertisement on BoliApp is not an endorsement by BoliApp.
13. Moderation, suspension and termination
To protect users, enforce these Terms and comply with the law, we may take the actions listed below, depending on how serious the issue is and whether it has happened before. We may act without advance notice where there is a risk of fraud or harm or where the law requires it.
Where it is safe and lawful to do so, we will tell you what action we took and why. If you think we made a mistake, you can ask us to review the decision through boli-app.com/help/contact.
You can close your account at any time by contacting us through boli-app.com/help/contact or, where available, from your account settings. Closing an account does not cancel obligations from deals already agreed, winning bids, open disputes or unpaid fees. Parts of these Terms that by their nature should continue, such as the content licence for already-shared content, disclaimers, limits on liability, indemnity and governing law, remain in effect after closure or termination.
- remove, hide or reject listings, messages, reviews or other content
- issue a warning, reduce visibility, or limit features such as posting, chatting, offers or bidding
- cancel auctions, void bids or cancel orders paid through BoliApp checkout
- freeze or hold wallet balances while we investigate
- suspend or permanently terminate an account or store, and block related accounts
- preserve records and share information with law enforcement and regulatory bodies, such as the FIA Cyber Crime Wing or the Pakistan Telecommunication Authority (PTA), when required by law or a valid legal order
14. Disclaimers and limitation of liability
The Platform is provided "as is" and "as available". To the fullest extent permitted by law, BoliApp gives no warranty that the Platform will be uninterrupted, error-free or secure, or that listings, user information, AI outputs or search results are accurate, complete or reliable. More detail is in our Disclaimer (boli-app.com/legal/disclaimer).
Because BoliApp is not a party to deals between users, we are not responsible for the quality, safety, legality or delivery of items, properties, jobs or services, for the truth of listings, or for whether a user is able to complete a deal. Any claim about a deal settled outside BoliApp checkout must be made against the other user.
To the fullest extent permitted by law, BoliApp and its directors, employees and partners are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, business, data or goodwill, arising from your use of the Platform. Our total liability to you for any claim relating to the Platform is limited to the fees you paid to BoliApp for paid services in the 12 months before the event giving rise to the claim, plus, for a deal paid through BoliApp checkout, the amount of that payment that BoliApp still holds.
Nothing in these Terms excludes or limits any liability or consumer right that cannot be excluded or limited under the laws of Pakistan.
15. Indemnity
You agree to indemnify and hold harmless BOLIAPP Private Limited and its directors, employees and partners against any claim, demand, loss, penalty or expense, including reasonable legal fees, brought by a third party or a public authority that arises from your User Content, your listings or deals, your breach of these Terms or our policies, or your violation of any law or of the rights of another person.
16. Complaints, reports and takedown notices
You can report a listing, user, message or review with the report option in the app, through the Contact page at boli-app.com/help/contact, or by email to info@boliapp.pk. Rights holders and people affected by unlawful content can send a takedown notice in the same way.
So that we can act quickly, a complaint or notice should include the details listed below.
We acknowledge complaints within 2 working days and aim to give a decision or full response within 7 working days. Complex cases, such as checkout disputes that need evidence from both sides, may take longer, and we will keep you updated. Where content is clearly unlawful or puts someone at risk, we act as quickly as possible, and we comply with directions from the PTA and other competent authorities under PECA.
If you are not satisfied with our response, you can reply to it and ask for the decision to be reviewed by a senior member of our trust and safety team. This does not affect your right to approach a consumer court, the FIA Cyber Crime Wing, the PTA or any other competent authority.
- your name and contact details
- a link to, or the ID of, the listing, profile or message concerned
- a clear description of the problem and, for rights complaints, proof that you own the right or are authorised to act for its owner
- a statement that the information in your complaint is true to the best of your knowledge
17. Changes to the Platform and these Terms
We may add, change or withdraw features, including paid services and BoliApp checkout, to improve the Platform or to meet legal and payment-provider requirements.
We may update these Terms from time to time, and the date on this page shows when they were last updated. If a change materially affects your rights, we will notify you by email, push notification or a notice on the Platform before it takes effect. If you continue to use BoliApp after the change takes effect, you accept the updated Terms; if you do not agree, you should stop using the Platform and may close your account.
If any part of these Terms is found to be invalid or unenforceable, the rest remains in force. If we do not enforce a right, that is not a waiver of it. You may not transfer your rights under these Terms without our consent, but we may transfer ours to a successor of our business. If there is any conflict between the English and Urdu versions of these Terms, the English version prevails.
18. Governing law, disputes and contact
These Terms, and any dispute arising out of or in connection with them or your use of BoliApp, are governed by the laws of Pakistan. Subject to any rights you have under consumer protection law that cannot be waived, the courts at Lahore have exclusive jurisdiction.
Before starting legal proceedings, please contact us so we can try to resolve the matter amicably. Disputes between users about a deal remain between those users, although we may help by sharing information we hold where the law allows.
